Booking terms and Conditions

Booking:

Please phone 0033 450 933975 or 0044 7947 075 360 or email chaletbrio@aol.com to check availability and make a provisional booking.

Complete the booking form and return it, email is fine, together with a 25% deposit to arrive within 7 days. The deposit can be made via internet banking and can be paid in sterling or euros.

Final balance will be due no later than 8 weeks prior to commencement of rental period.

We: means Caroline or Robert Thompson of Chalet Brio, Le Bouchet, L’Etelley, 74340 Samoens, France

You (the client): are the person in whose name the booking is made and includes all other members of your party

The property: refers to either Chalet Brio or La Terrasse, L’Etelley, whichever you have booked.

Bookings and deposits:
A booking is valid once your completed and signed booking application form has been received and your deposit payment has been cleared. Your signature on the booking form confirms that you have read and fully understood these terms and conditions and that the agreement is made between us, yourself and all those listed on the booking form. We will then send you a letter of confirmation. We do reserve the right to refuse to accept any bookings at our discretion, refunding any deposit received.

Catered accommodation is usually, but not always, in Chalet Brio and self catered in La Terrasse. We will always try and accommodate clients in the chalet of their choice, but we reserve the right to make changes if necessary.

Terms of payment:
We must receive the full balance of the holiday price no later than 8 weeks prior to the date of your holiday booking, and if not, we reserve the right to cancel the booking and/or levy cancellation charges

Cancellation by the Client

If you need to cancel you must inform us in writing and send it by recorded delivery, email or fax. The date of cancellation will apply from the date of receipt. The following cancellation charges will apply:

If notice of cancellation is received more than 56 days before the rental period starts we retain your deposit.

Between 56—43 days before the rental period starts 50% of the full price

Between 42—28 days before rental period starts 60% of the full price

Between 27—15 days before rental period starts 80% of the full price

Between 14 days and start of the rental period 100% of the full price

If a cancellation charge arises you must pay this within 7 days and it is then your responsibility to recover the costs from any others on the booking form and to claim under any insurance policy. We strongly advise you and all other group members to take out holiday insurance. In certain circumstances if we are able to relet the property we will refund an equivalent proportion of your deposit i.e. if relet at 75% of full price, we will refund 75% of deposit.

Cancellation by the owner:
We reserve the right to cancel bookings if conditions arise beyond our control. If this is the case we will either try and offer alternative accommodation or refund your payments, but no additional compensation will be payable.

Damage or loss:
You are liable for any damage caused to the buildings or contents or to a third party, whether caused by yourself, or others, including children, in the party. Any minor costs will be deducted from the security deposit and we are entitled to recover any additional costs from you at the time or within a maximum of 21 days.

We take all reasonable in relation to security of valuables and provide you with a key to your bedrooms and the code for the entrance door. It is up to you to make sure that you are all responsible for the safety of your own equipment, possessions and valuables. We accept no responsibility or liability in this respect.

We reserve the right to terminate without notice, the holiday of any group member whose behaviour disrupts the enjoyment of others or causes damage to the property or any third party.

You are responsible for supervising any children with you at the property and we do not accept liability in respect of any loss occurring as a result of your failure to do so.

Self Catering (including those on flexi catered arrangements):
You are responsible for leaving the accommodation clean and tidy on your departure with any breakages replaced or paid for. If additional cleaning is needed, beyond that included in the rental price, the cost of this will be deducted from your security deposit, along with the cost of any damage or breakages.

Liability of the owner:
We accept responsibility for ensuring that the facilities and services offered at the properties reach a reasonable standard, but we don’t accept liability for any disappointment which you may feel as a result of unrealistic expectations. All the photographs, verbal and written descriptions are given in good faith and believed to be correct, but we reserve the right to make some changes and replacements as necessary.

We are not liable for any claims which result from circumstances beyond our control such as terrorist activity, bad weather or traffic and travel conditions.

We do not accept any liability for personal injury or death wheresoever or howsoever caused to any guest during their stay. This does not affect any statutory rights you may have.

Any complaints you do have should be raised with us during your stay, and we will try and deal with them before you leave, or within a maximum of 7 days of the end of your stay with us.

If a claim arises involving a third party we ask for your full assistance in pursuing any such claim.

Insurance:
You are strongly advised to take out adequate medical and holiday insurance for yourself and all others in your party from the time of your booking.

Jurisdiction:
This agreement is subject to English law.
